Please carefully read the Web Site Terms and Conditions of Sale Agreement set out below before purchasing any downloadable audio or audio-visual files or other products or services from iBoot through this Site.

1. Scope of Agreement
This Web Site Terms and Conditions of Sale Agreement (this "Agreement") is between you ("You" or "Your") and iBoot. ("iBoot"). This Agreement governs Your purchase of any Files (defined below) or other products or services (such other products and services,
collectively, the "Other Products") from iBoot through iBoot’s web site (this "Site"). In addition to complying with the terms of this Agreement, You agree to comply with the Terms of and Conditions of Use Agreement that governs Your access to and use of this Site with all additional terms and conditions governing access to and use of specific areas of this Site set forth elsewhere on this Site (collectively,"Additional Terms"). The Terms of Use, any Additional Terms, and iBoot’s Privacy Policy are incorporated into and made a part of this Agreement. Capitalized terms used but not otherwise defined in this Agreement have the meanings given such terms in the Terms of Use. One "Credit" is equal to downloading one File. Individual Files purchased one at a time are $29.95 USD, as posted on the Site. Prior to purchase, You will be required to choose whether You wish to purchase A sandbag which is an additional fee of $7.64 USD plus shipping and handling.

2. Binding Agreement
BY COMPLETING A PURCHASE OF ANY FILES OR OTHER PRODUCTS ON THIS SITE, YOU ARE DEEMED TO HAVE READ, UNDERSTOOD, AND AGREED TO EACH OF THE TERMS, CONDITIONS, AND NOTICES SET FORTH IN THIS AGREEMENT AND IN ANY INCORPORATED AGREEMENT, POLICY, OR OTHER TERMS AND CONDITIONS. IF YOU DO NOT UNDERSTAND AND AGREE TO EACH OF THE
TERMS, CONDITIONS, AND NOTICES HEREIN AND AS SO INCORPORATED, YOU SHOULD NOT PURCHASE ANY FILES OR OTHER PRODUCTS ON THIS SITE.

3. Product Pricing, Information, and Ordering.
(a) iBoot sells copies of downloadable audio files ("Audio Files") and downloadable audio-visual files ("Video Files") containing one or more exercise programs (Audio Files and Video Files, collectively, "Files"). Each File contains one or more exercise programs designed and presented by one of iBoot’s workout instructors. iBoot may also sell Other Products. iBoot offers individual Files to be purchased one at a time

(b) Individual Files purchased one at a time are $29.95 USD, each as specified on this Site with the description of the File.

(c) iBoot will use commercially reasonable efforts to fulfill Your orders of Files or Other Products, but iBoot cannot and does not guarantee the accuracy or completeness of information on this Site, including prices advertised other than on this Site, product images, specifications, availability, and services displayed on, offered for sale, or sold through this Site. iBoot and its vendors and suppliers each reserve the right discontinue the sale of any Files or Other Products and offered for sale on this Site at any time
and without prior notice to You.

(d) Prices for and information about Files and Other Products listed on this Site may vary from other advertised prices and information. iBoot is bound only to the File prices and information listed on this Site. Such prices are quoted and payable in United States Dollars, are valid and effective only within the United States, and do not include sales taxes, if applicable, which will all be added to Your total invoice price. You are solely responsible for the payment of state and local sales or use taxes that may apply to Your order.

4. Payments
(a) Payments for Files, and Other Products must be made by credit or debit card. Currently, iBoot accepts the following credit cards: Visa, MasterCard, and American Express. iTRAIN may utilize a small-charge aggregation system to save credit and debit card processing costs so that small charges You make to the same credit or debit card, for individual Files or for Other Products, may be held by iBoot or its aggregator until the total of such charges reaches the billing threshold (generally, up to $30.00 USD depending on the credit card company) and then processed as a single charge.

(b) If there is a problem with Your method of payment, iBoot may make reasonable
efforts to contact You to resolve the problem. If iBoot is unable to charge Your designated credit or debit card, iBoot reserves the right to collect the outstanding amount You owe or to seek legal action against You for breach of these terms. These remedies are not exclusive.

6. Warranties; Disclaimer; Limitation of Liability
(a) WARRANTY DISCLAIMER.
ALL FILES AND OTHER PRODUCTS ARE SOLD "AS IS" AND ON AN "AS AVAILABLE" BASIS. IBoot DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE, NONINFRINGEMENT, TITLE, QUIET ENJOYMENT, DATA ACCURACY, OR SYSTEM INTEGRATION. THIS SITE AND THE FILES AND OTHER PRODUCTS ARE NOT A SUBSTITUTE FOR THE ADVICE AND TREATMENT OF A LICENSED HEALTH CARE PROFESSIONAL. IBoot DOES NOT GUARANTEE THAT ACCESS TO THIS SITE OR TO THE FILES SHALL BE UNINTERRUPTED AND ERROR FREE, AND IBoot MAY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER IBoot; ITS PARENT, SUBSIDIARIES, OR AFFILIATES; NOR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, MEMBERS, PARTNERS, EMPLOYEES, OR AGENTS SHALL BE LIABLE FOR PUNITIVE, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, INDIRECT, OR SPECIAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, REVENUES, BUSINESS, USE, DATA, OR OTHER INTANGIBLES), WHETHER OR NOT SUCH DAMAGES WERE FORESEEABLE OR IBoot HAD BEEN ADVISED OF THE POSSIBILITY OR LIKELIHOOD OF SUCH DAMAGES.

(c) MAXIMUM LIABILITY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IBoot’s TOTAL LIABILITY TO YOU FOR ANY DAMAGES (REGARDLESS OF THE FORM OF ACTION, WHETHER CONTRACT, WARRANTY, TORT, PRODUCT LIABILITY, OR OTHERWISE) SHALL NOT EXCEED IN THE AGGREGATE THE AMOUNT OF FEES ACTUALLY PAID BY YOU TO iBoot FOR THE ONE MONTH PERIOD PRIOR TO THE ACT ALLEGEDLY GIVING RISE TO IBoot’s LIABILITY.

7. Single use license
PLEASE READ THIS CONTENT LICENSE AGREEMENT ("LICENSE") CAREFULLY BEFORE USING THE iBoot CONTENT. BY USING THE iBoot CONTENT, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS LICENSE. IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENSE, DO NOT USE THE CONTENT. IF YOU DO NOT AGREE TO THE TERMS OF THE LICENSE, CLICK "DISAGREE/DECLINE".

Usage
